If a artist signs a contract by recording company 5 years ago and never recorded but wants out of the contract, will that be considering breaching the contract?

Would need more information on the clauses for termination and term of contract. Generally speaking (and going by the standard record agreements, you would have infringed your duty that is to provide a minimum quantity of recordings to the label, but the term of the contract may have ended and therefore it's debatable that the record label should have made their case within the term of the contract. Very gray area though, do you have any specific clauses you can share? I am not a specialist lawyer but I could have someone who is take a look.

This all depends on the language in your specific contract. As marcustaylor corrently mentions, you may have an obligation to deliver a minimum amount of recordings to the label; however, the term may have already expired. I would recommend having an entertainment attorney review the agreement and advise on next steps.
