  3. Hmmm There seems to be a lot of looking inside yourselves at what to write about. The truth is, mist times inspiration comes from a reaction to something external. That reaction itself is a chain or chains of thought that we as writers channel and present as perspective. In other words, no matter who we are, or how empty or nothingness we feel, we always react to the world. Writers present their perspective on that world, but the seed of ideas is not something we comb our brains for when we have nothing better to do, it is events and stimulus happening now, or experienced now. Looking inside is okay, and certainly it can come up with ideas based on memory, but the most fertile ground, for me, us that of reaction. It could be something you see or hear, or feel. Creativity works best with regular, ongoing stimulus. Some types are better than others and the combination varies from person to person. Memory is fickle. The world is a great stimulus. It is full. Over full. More ideas in a square inch than you know what to do with. In fact, that is often a big problem... People start looking and once their eyes are opened, they are overwhelmed with possibilities. So my recommendation is just that. Look outward. Learn how to see again.

  12. Hey Donna, Oh I agree in the UK and as far as I know the rest of the EU including Ireland, it is considered to be published. I used to think the same was true in the USA, the only doubt being placed in my mind by Mr Sage lol but I do get where the online doubt comes from. The same is also true over who the publisher is, the site or the individual. As ever the law progresses like a snail. Has the definition of publishing in the USA become any more settled? Cheers John

  15. In which case both you and Nerndt are right. I am not an expert in copyright law. I certainly used to think that it was publishing in the US until someone told me it wasn't... I thought that was you! LOL In the UK and Europe posting on Songstuff is considered publication. Who knew? lol

  17. I didn't mean to jump all over you Bernd, not at all, but in this kind of situation I thought you would want to be as informed as Donna is now and why she has involved her PRO at all. Your advice was pretty well bang on the money.

  19. Donna is using the legal advice of her PRO, that is all, as a firmer footing than the advice she received here... Which largely agrees with what you yourself have said. The registration being discussed is not Donna's PRO registration, or her songs PRO registration, it was their registration with the US copyright service. They are not a PRO. What constitutes publishing has a legal definition. In the USA that definition is tied to the notion of there being some form of financial transaction, even if that is one cent. Conformance with DMCA is dependent on the location of the site and whether the country they are resident in accepts the Berne Convention. DMCA itself is a US copyright law. The Electronic Commerce Directive 2000 implements the same WIPO directives in Europe and is the equivalent to DMCA. The point is, in general a take down notice works in most countries but the corresponding legislation is not normally DMCA.
